FLORIDA MARSY LAW LESSON
Protecting Crime Victims While Preserving the Accused’s Right to Defend Educational purposes only. This lesson explains Florida law and procedure and is not individualized legal advice.** --- # 1. THE BIG PICTURE Marsy’s Law is the name commonly used for Florida’s constitutional protections for crime victims. The primary authority is: ### Florida Constitution, Article I, Section 16 ### “Rights of accused and of victims” This title is important because **the same constitutional section protects both the accused and the victim.** Subsection **16(a)** protects the accused. Subsections **16(b) through (e)** establish and define the constitutional rights of crime victims. Florida’s system therefore is not supposed to operate on the theory that: > Victim rights defeat defendant rights. Nor should it operate on the theory that: > Defendant rights eliminate victim protections. The legal system must protect **both interests at the same time whenever reasonably possible.** Article I, section 16 expressly gives victims rights beginning at the time of victimization, including due process, protection from harassment, privacy protections, participation in proceedings, restitution, and other rights. That balance is the central concept of this lesson. --- # 2. WHO IS A “VICTIM”? Under: ### Florida Constitution, Article I, Section 16(e) ### “Rights of accused and of victims” a victim is generally a person who suffers direct or threatened: * physical harm; * psychological harm; or * financial harm because of the commission or attempted commission of a crime or delinquent act, or the person against whom the crime or delinquent act was committed. The definition can also include certain: * lawful representatives; * parents or guardians of minor victims; and * next of kin of homicide victims. But there is an important limitation: ### The accused is not considered the victim of the crime for which that person is accused. ## Jack and Jill Jill reports to the sheriff:
