Overpayment out of the blue
My Daughter is an adult with Down Syndrome. She receives her own SSA benefits, but since I retired in 2020 she has also collected from my benefits. Talking to SSA on the phone, not sure where she was located, it was not our fault and should be "reconsidered" with a form SSA-561.There was a calculation error, we are told from our local office, that resulted in a $20,000 overpayment. We did that once, when this first came up in December of 2024, never heard a response until the end of July 2025 when another letter came demanding money. No explanation or response from our original appeal. That's the 40,000 ft view, but really not much more relevant facts to present. Should I get an attorney? I today's political climate what are my odds of this just going away? We have an appointment with the local office - who did the calculation wrong - in a couple weeks. Not sure if they have any incentive to fix this for us. Thanks for any direction! Kevin

@Ed Weir The series is very informative. I have a question about SSA-632 and the conditions for using it. 1) It was not our fault, I think SSA will agree to that. Is that alone enough cause for the waiver, or do we ALSO 2) have to prove that the household cannot afford to pay it back? They can dig into our bank records and our daughter's STABLE account (Ohio's ABLE account) and find enough to be repayed. 3) Can a 50% reduction be negotiated without having to dig through our financials? @Ed Weir I have submitted SSA-561 and intend to follow up with the SSA-632-BK. During a phone call into the SSA, I was told that the overpayment was caused by an error in the local office. I have a meeting with the local office and I would like to know the "right questions" to ask to explain the cause of the overpayment - without stepping on toes. (Section 2 of the SSA-632) Past meetings at the office, the SSA employee is always in front of the computer, and never shows is information related to our account. I would like to see any notes on our file about past meetings. Is it reasonable to let us see our records and what they are seeing on the system?
