Tax Refund
Hi everyone, I’m hoping to get some guidance in the group regarding a significant IRS refund delay. I filed my tax return on time by April 15 and am expecting a 6 figure federal refund. My IRS online account indicates that the return has been received and reviewed, but the refund has now been processing for approximately 4 months with no meaningful update. After reviewing my IRS Account Transcript, I noticed Transaction Code 810 – “Refund Freeze.” From what I understand, this means the IRS has placed a hold on issuing the refund while something on the return is being reviewed. I have tried repeatedly to contact the IRS using the customer service number and extension provided through my IRS account. I’ve called on multiple days and at different times, but every attempt ends with the automated message that, due to unusually high call volume, they are unable to take my call and I should try again later. At this point, I have waited patiently for over 4 months and am becoming increasingly concerned, particularly given the size of the refund. For anyone who has dealt with a Code 810 refund freeze, I would really appreciate your advice: - Is there a better way to reach the appropriate IRS department or get this escalated? - At what point would you recommend involving the Taxpayer Advocate Service? - Is there anything I can do to determine why the 810 freeze was placed and what is needed to have it released? - Are there any other escalation channels I should consider given the amount involved and the length of the delay? Would especially appreciate insights into this situation from @Ryan Bakke, CPA @Kevin Medina, CPA, MBA @Mason Kimball, CPA who have successfully handled a similar situation for a client. Thank you!

STR Joint Venture - need advise on LLC Setup and material participation
Purchasing an STR in AZ. Myself a resident of NJ. This STR will be a JV in between myself and a friend who will contribute some capital , have preferred returns, some equity, will help somewhat in the whole ordeal - acquisition, setup and operations just to fulfill his 100hrs to get depreciation. I will be doing rest of the work. Need advise on where the LLC should be setup - in AZ or NJ is fine? Any recommendations for attorneys who could help setup such a JV deal at a reasonable price? Would there be a challenge in both of us claiming 100hrs of material participation? I do have other STR’s through which I am easily able to show approx 500hrs or maybe even REPS this year (w/ 750hrs). Thanks

Is there a maximum amount/cap to the business losses that can flow into W2/1099 income if showing active participation in STR? @Ryan Bakke, CPA

@Ryan Bakke, CPA - yes. That’s what my current CPA tells me. Just to confirm my understanding: does this mean there’s effectively no benefit to generating or claiming depreciation beyond the ~$626K limit in a given year, since the excess would simply carry forward?
