Usury
Hey guys, I was reviewing an EMD deal in TX, and it seems like the max AI interest rates allowed are generally capped at 10-28%. Because our fees are earned in such a short duration the APR is considered usurious. Any thoughts on this?

@Paul Brown I did not realize this about TX as I'm more familiar with NC. TX does have laws that cap usury at 10-28% i think. There was a recent case law that required an actuarial method used to calculate it. For very short transactional funding lengths, the APR becomes very high and would be considered usurious. I believe one of the work arounds is to be a CSO/CAB, which is what payday loan companies use.
What Should You Prepare Before Approaching a Property Funder?
One thing I’m interested in learning more about is how property investors can make their funding requests clearer and easier to assess. Before approaching a potential funder, I imagine it helps to have a few key details organized. - The deal numbers: purchase price, estimated renovation costs and expected resale value or rental income. - The funding requirement: how much is needed, what it will cover and for how long. - The exit strategy: how the funding will be repaid. - The risks: potential challenges, unexpected costs and how they might be managed. I think having this information prepared can help make conversations more productive and highlight any gaps before moving forward. For those with experience in property funding, what information do you consider most important when assessing a deal? And for those still learning, which part of the process do you find most challenging?

Hey Ethan, as a lender, i usually need the property address, business plan, exit strategy. As a borrower, i would love to see someone that has realistic numbers, cash or equity to bring to the table, decent communication skills and good show of character. Having enough cash/equity and character would be higher priority for me. I would not place too much weight on the risks as i think the lender would do their own due diligence. Feel free to DM me to connect!

Can You Fund EMD Yourself, Independently?
I'm interested who in this group can manage EMD completely independently and might want referrals on deals that offer high payouts at close but need lower upfront fees that we charge. We might be able to refer some periodically. I'll check on this kind of these at times to make sure I understand our group skills. :) @Khalil Yusuf @Mandy Cartagena @Kathleen Miller @Jamey Marcos @Brenda Villafranco

30 days for first position funds
I have someone who needs 70k to 200k range max , for 30 days only , my borrower buys her deals outright then sell it , and she sticks within 30 days only … I don’t mind getting HUDs from deals she successfully closed in the past 3 to 6 months.. I would love to see who would want to hop on a call and connect with her when it comes to her strategy, she say she doesn’t mind high interest but anything is possible. The lender will be first position.

Mobile home park improvements - Anderson, CA ($150k) 3. Private capital partner: 7 laundromat portfolio - Bend, OR ($450k)
